Two Things You Need to Know About the Food Safety Modernization Act (FSMA)
The Food Safety Modernization Act applies to food facilities that manufacture, process, pack or hold food for consumption in the USA, and aims to prevent food borne illnesses by requiring science-based controls. The highly pathogenic avian influenza (HPAI) H5N1 strain that has killed cats and infected humans, dogs and cattle has forced the FDA for the first time to invoke FSMA regulations requiring pet food manufacturers to reanalyze their food safety plans to include HPAI. FDA inspectors will be actively looking to review the reanalyzed plans to ensure food safety compliance within the next 90 – 120 days.
Foreign suppliers are required to provide assurances that food products meet substantially similar requirements to U.S.-based companies via the Foreign Supplier Verification Program (FSVP). U.S. owners or consignees of food products being imported are subject to FSVP. Failure to comply will result in financial and legal penalties, FDA enforcement action and reputational damage.
